RUSYA, BELARUS VE İRAN ÇIKIŞLI/VARIŞLI KARGO YAPTIRIMLARI

Türk Hava Yolları kargo taşımacılığı için belirli ülkelerle ilgili yaptırımlara uyum sağlama konusunda acentelere yönelik bir dizi talimat ve kural içeriyor. İşte metinde belirtilen bazı önemli noktalar:

  1. Transit Ülkeler ve Yasaklı Kargo: Yasaklı ülkelere transit ülke kullanarak kargo taşıması yapmak yasaktır. Örneğin, yasaklı bir kargonun belirli bir ülkeye teslim edilmesinden sonra, adı geçen ülkelere transfer edildiğinin tespit edilmesi halinde, bu duruma engel olunacaktır.
  2. Bilgi Eksiksizliği ve Doğruluğu: Rusya, Belarus ve İran çıkışlı/varışlı kargolar için alıcı, gönderici, acente, ürün tanımı ve GTİP kodu gibi bilgilerin eksiksiz ve doğru bir şekilde girilmesi gerekmektedir. Rezervasyon sonrası bu bilgilerde değişiklik yapılmamalıdır.
  3. Ambargo Altındaki Ürünler: Madencilik sektörü ve petrol&gaz sektöründe hizmet veren alıcı/gönderici firmalarının kargoları ile yüksek teknoloji ürünleri ve ağır sanayi ürünlerinin ve bu ürünlerin yedek parçalarının ambargoya tabii olanlarının ilgili ülkelere taşınması yasaktır.
  4. Bilgi ve Belgelerin İletilmesi: Müşterilerden talep edilen bilgilerin zamanında ve eksiksiz bir şekilde iletilmesi gerekmektedir. Talep edilen bilgiler sağlanmadıkça kargo onaylanmayacak olup, yaşanacak aksiliklerden Türk Hava Yolları sorumlu olmayacaktır.
  5. GTİP Kodu ve Ürün Tanımı: GTİP kodu ile ürün tanımı arasındaki uyumsuzluk ret sebebidir. Bu nedenle, bu bilgilerin doğru ve uyumlu olması önemlidir.
  6. İhracat Lisansı: Acente, ABD Ticaret Bakanlığı’ndan alınan İhracat Lisansına sahip ise, bu bilgiyi rezervasyon sırasında belirtmelidir. Aksi takdirde kargo reddedilir.
  7. Ret Durumunda İade Masrafları: Herhangi bir ret durumunda oluşacak iade masraflarından acenteler sorumludur.

Bu talimatlar, Türk Hava Yolları’nın yaptırımlara uyum sağlama politikalarını ve yasal gereksinimlerini vurgulamakta ve acentelerin bu konuda gerekli hassasiyeti göstermesini sağlamaktadır.

NOTIFICATIONS FOR AGENTS REGARDING COMPLIANCE WITH SANCTIONS ON SHIPMENTS
TO/FROM TO RUSSIA, BELARUS AND IRAN
• It is prohibited to ship sanctioned cargoes to Russia, Belarus and Iran via a transit country. For
example, a cargo, e.g. an aircraft engine, cannot be transferred to mentioned countries after
delivered to the customer in a country such as Kazakhstan, Vietnam, Tajikistan and Maldives.
Such attempts by agencies may culminate in reconsideration of trade relations between
Turkish Airlines and them since the latter is decisive about not facilitating circumvention of
sanctions.
• Turkish Airlines carries out cargo transportation in compliance with international sanctions
and expects the necessary sensitivity from its business partners. In this context, it is extremely
important for agencies to comply with the rules listed below.
• When making reservations via TK GO, COMIS Systems and telephone for cargo
departing/destining from Russia, Belarus and Iran, the information of SHIPPER NAME,
CONSIGNEE NAME, AGENCY, PRODUCT DESCRIPTION, HS CODES must be entered
COMPLETELY AND CORRECTLY; No changes must be made to the relevant information after
the reservation.
• It is forbidden to transport high-technology products, heavy industry products and spare parts
of these products, as well as the cargo of shipper/consignee companies serving in the mining
sector and oil & gas sector, to the relevant countries subject to embargo.
• In a reservation that includes the agency name in the shipperrece information, real persons
or legal entities who are the actual owners of the cargo must be entered in the recipient
information.
• FWB/FHL messages should be shared early in the booking process.
• After the first reservation is received, any changes made to the reservation bring the relevant
reservation back to approval/rejection status. For this reason, regardless of where the
relevant cargo is located, if a second scan made by the Accuity system as a result of a change
made on the reservation determines that the relevant cargo should be subject to embargo,
the shipment will be rejected. For this reason, it is important that the information entered
when the first reservation is made is correct and not changed.
• When evaluating cargo originating to/from destined to relevant countries, the Sanctions team
is not only bound by the Prohibited HS Code list, but has the right to reject the reservation
when deemed necessary.
• Failure to receive complete information requested from customers when necessary or any
delay in providing the information is a reason for rejection. Necessary information requested
from customers must be provided in a timely manner. Unless the requested information is
provided, the cargo will not be approved and Turkish Airlines will not be responsible for any
mishaps.
• Any changes to the HS code or goods description made without changing the product content
on a reservation that is rejected due to the HS Code being prohibited will result in the rejection
of re-booked reservations. In order for us to ensure the shipment, it must not contain any
prohibited products.
• Inconsistency between product description and HS code is a reason for rejection.
• There is a possibility that the cargo can be rejected by us until it is delivered to the consignee,
and the approval previously given to the relevant cargo can be rejected after various
investigations are made as a result of any changes made in the reservation. Turkish Airlines is
not responsible for any disruptions that may arise due to this reason. For this reason, it is
important to enter all information accurately and completely when making a reservation.
• After all information regarding the reservation is made through COMIS, TK GO and our
reservation team, the reservations received are scanned by the Accuity System. Since it is not
possible to scan before the reservation is made, the approval or rejection of the cargo is seen
in the scan after the reservation is received. For this reason, it is important to enter correct
information when making a reservation. Additionally, any manual changes requested to be
made on the reservation will not be approved by us. For each change made, the reservation
must be changed through the system.
• If the agency has an Export License from the US Department of Commerce, it must indicate
that Relevant agency has the relevant license during the reservation. Otherwise, the cargo will
be rejected.
• In case of any rejection, the agency is responsible for the return costs.
• Questions asked for consultation purposes before making a reservation will not be accepted
by the Sanctions team. Because the approval or rejection information given to any question
by e-mail or telephone is not valid and the final decision is made based on the Accuity system’s
scanning of the reservation.
• Any approval or rejection given verbally or in writing by the Sanctions team is not valid. The
final result of the reservation is given through the Accuity System.
• Agencies that have difficulty complying with the specified embargoes and do not take into
account the warnings will face the risk of being blacklisted. If these behaviors continue despite
warnings about sanctions rules, the option of not doing business with the agency can be
activated.
It is important to show the necessary sensitivity in practice.
